Terms of Service

1. Acceptance

By creating an account or using Homecierge, you agree to these terms and our Privacy Policy. If you don't agree, don't use the platform. These terms apply to both homeowners/renters and service pros.

2. What Homecierge Is

Homecierge is a marketplace — we connect homeowners with pros. We're not a contractor, employer, or service provider.

Pros on the platform are independent contractors. They're responsible for their own licensing, insurance, and work quality.

We vet pros through background checks and license verification, but vetting doesn't guarantee the quality of their work.

3. Homeowner Responsibilities

Describe your job accurately. Include photos where relevant.

Be reachable when pros are matched to you.

Only release payment after confirming the job is done to your satisfaction.

Don't try to hire pros you meet through Homecierge outside the platform. Doing so means you lose all payment protections.

4. Pro Responsibilities

Keep all licenses and insurance current. Texas trades must comply with TDLR (electrical, HVAC) and TSBPE (plumbing).

Provide accurate pricing in offers. Changes after booking require homeowner approval.

Complete jobs to professional standards and within the agreed timeline.

Don't solicit homeowners for direct hire during or within 12 months of a Homecierge job.

5. Payments

Homeowners pay through Homecierge via Stripe. Funds are held in escrow until the homeowner confirms completion.

Pros receive payment within 2 business days of job confirmation.

Homecierge charges a platform fee on completed transactions. Current rates are in your account settings.

Payment disputes go through our resolution process. Homecierge's decision is final.

6. What's Not Allowed

False or misleading job requests or offers.

Harassing, threatening, or discriminating against any user.

Bypassing the payment system.

Fake reviews or rating manipulation.

Using the platform for anything other than home services.

Breaking any local, state, or federal law.

7. Our Liability

Homecierge is a marketplace and isn't liable for the quality, safety, or legality of services pros perform. Our maximum liability to any user is limited to the fees paid to Homecierge in the 3 months before the claim. We're not liable for indirect or consequential damages.

8. Disputes

Disputes go through our internal resolution process first. If unresolved, they go to binding arbitration under AAA rules in Dallas County, Texas. Class action waivers apply.

9. Account Termination

We can suspend or terminate accounts for violations, fraud, or conduct that harms others on the platform. You can delete your account anytime in account settings.

10. Governing Law

These terms are governed by Texas law, without regard to conflict-of-law rules.

11. Changes

We may update these terms as the platform grows. We'll give you 30 days' notice of material changes via email. Continued use after that means you accept the new terms.
